Terms of Service

The agreement that governs your use of the Applied Architecture Group website and the Genxus AI platform, including the Genxus Discord bot. Please read it — it defines what the Services are, what they are not, and how risk is allocated.

1. Acceptance of these terms

These Terms of Service (“Terms”) are a binding agreement between you and Andrew Naron, operating as Applied Architecture Group and as operator of the Genxus platform (“we,” “us,” or “our”). By accessing or using our website, the Genxus platform, or any Genxus bot or interface (together, the “Services”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of a business or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

2. Who we are

The Services are operated by Andrew Naron, based in St. Louis, Missouri, United States. Applied Architecture Group is a vendor-neutral operations, systems, and AI advisory practice. Genxus is our AI and automation platform, which includes software, interfaces, bots, and integrations such as the Genxus Discord bot.

3. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) and legally able to enter into these Terms. The Services are intended for business and professional use.

4. The Services

The Services include informational website content, the ability to contact us and request consultations or assessments, and access to the Genxus platform and its bots, which generate text responses and related outputs using artificial intelligence. The Genxus Discord bot operates only within a designated, access-restricted channel and is provided as a read-only assistant — it generates responses and does not perform actions on your systems, accounts, or data on your behalf.

We may add, change, suspend, or remove features of the Services at any time. The Services are provided for general informational and operational purposes and may not be error-free or continuously available.

5. Access & the Genxus bot

Access to the Genxus platform and its bots may be limited, invitation-based, or subject to allowlisting. You are responsible for activity that occurs through your access, for keeping any credentials secure, and for complying with the rules of any third-party platform (such as Discord) through which you reach the Services. We may revoke or restrict access at any time, with or without notice.

6. Acceptable use

You agree not to, and not to permit anyone to:

  • Use the Services in violation of any applicable law or regulation, or to infringe anyone’s rights;
  • Submit content that is unlawful, harmful, harassing, defamatory, or that you do not have the right to submit;
  • Attempt to gain unauthorized access to the Services, other users’ data, our infrastructure, credentials, or any system or network;
  • Probe, scan, overload, disrupt, or interfere with the integrity or performance of the Services, or circumvent access controls, rate limits, or the bot’s allowlist;
  • Attempt to manipulate the AI to bypass its safeguards, extract credentials or system instructions, or cause it to exceed its intended read-only scope;
  • Use the Services to build a competing product, or to scrape, harvest, or resell outputs except as expressly permitted;
  • Submit others’ personal, confidential, or regulated data without a lawful basis and appropriate consent; or
  • Introduce malware or use the Services to transmit anything harmful.

We may investigate and take appropriate action, including removing content and suspending access, for any suspected violation.

7. AI output — important disclaimer

Read this carefully. The Genxus platform and its bots use artificial intelligence to generate responses. AI-generated output can be inaccurate, incomplete, outdated, biased, or entirely fabricated (“hallucinated”), even when it appears confident and specific.

All AI output is provided on an “AS IS” basis for informational purposes only. You are solely responsible for independently reviewing, verifying, and validating any output before relying on it or acting on it. Do not use AI output as the sole basis for any decision that carries legal, financial, medical, safety, or other significant consequences.

We make no representation that AI output is accurate, current, complete, or fit for any particular purpose. You assume all risk arising from your use of, or reliance on, AI output. Outputs are not reviewed by a human before delivery unless expressly stated.

8. No professional advice; no client relationship

Content on the website and outputs from the Genxus platform are provided for general informational purposes only and do not constitute legal, financial, tax, medical, engineering, or other professional advice. Using the website or the Services, submitting a form, or interacting with the bot does not by itself create a consulting, advisory, fiduciary, or other professional-client relationship. Any such relationship is formed only through a separate written engagement agreement signed by us. You should consult a qualified professional before acting on any information provided through the Services.

9. Intellectual property

The Services, including their design, text, graphics, logos (including the Applied Architecture Group and Genxus marks), and software, are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. You retain rights in the content you submit, and you grant us a license to use, process, and store that content as necessary to operate and improve the Services and as described in our Privacy Policy. You are responsible for ensuring you have the rights to any content you submit.

10. Third-party services

The Services rely on and interoperate with third-party platforms and providers, including Discord, our hosting and network provider, analytics, and any third-party AI model providers. Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for them. We are not affiliated with or endorsed by Discord.

11. Disclaimer of warranties

The services and all content and output are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the services will be uninterrupted, secure, error-free, or that any output will be accurate or reliable.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, in no event will Andrew Naron, Applied Architecture Group, Genxus, or any of their affiliates, providers, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of or inability to use the services or any AI output, whether based in contract, tort (including negligence), strict liability, or any other theory, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the services will not exceed the greater of (a) the total amounts you paid us for the specific service giving rise to the claim in the three (3) months before the event, or (b) one hundred U.S. dollars (US $100).

These limitations are a fundamental basis of the bargain between you and us. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Andrew Naron, Applied Architecture Group, Genxus, and their respective affiliates, agents, and service providers (the “Indemnified Parties”) from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services; (b) your violation of these Terms or the Privacy Policy; (c) your violation of any law or of any third party’s rights, including any content or data you submit; (d) your reliance on, or use of, any AI output; or (e) any content you submit to the Services. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense. This section survives termination of these Terms.

14. Availability & changes

The Services, including the Genxus bot, are provided on a best-effort basis with no guarantee of availability, uptime, or continuity. We may modify, suspend, throttle, or discontinue any part of the Services, including shutting down a bot, at any time and without liability. We may also change these Terms; when we do, we will update the “Last updated” date, and your continued use after changes take effect means you accept the revised Terms.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, the licenses granted to you end, and the sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

16. Governing law & disputes

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute not subject to informal resolution or small-claims court will be the state and federal courts located in or serving St. Louis, Missouri, and you consent to their personal jurisdiction.

Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally for at least thirty (30) days. Any claim must be brought within one (1) year after it arises, to the extent permitted by law. You and we agree that any dispute will be resolved on an individual basis and waive any right to participate in a class or representative action, to the extent permitted by law.

17. General terms

These Terms, together with the Privacy Policy and any engagement agreement, are the entire agreement between you and us regarding the Services and supersede prior understandings. If any provision is found unenforceable, the remaining provisions stay in effect and the unenforceable provision will be limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. Nothing in these Terms creates a partnership, agency, or joint venture between us.
